User Agreement (Public Offer)

for ordering, purchasing, and delivering digital products and services

This Agreement is an official and public offer by the Seller to enter into a purchase agreement for printed posters presented on the website www.averyano.com. According to Article 633 of the Civil Code of Ukraine, this Agreement applies equally to all customers regardless of their legal status.

By placing an order, the Buyer fully accepts the terms and conditions outlined herein. The Agreement is deemed accepted when the Buyer clicks the “Confirm Order” button on the checkout page and receives an order confirmation by email.

1. Definitions

• Public Offer – public proposal to enter into a remote sales agreement.
• Digital Product or Service – printed poster created and sold by the Seller.
• Website – www.averyano.com
• Buyer – legally capable individual or business entity.
• Seller – Sole Proprietor Kris Borysenko, ID 3489610716.

2. Subject

The Seller agrees to sell and deliver a printed poster, and the Buyer agrees to pay. All posters are based on original designs created by the Seller. Each purchase is for a physical product and does not grant any intellectual property rights to the Buyer.

3. Order

Orders are placed through the Website. The Seller may reject incomplete or suspicious orders. The Buyer must provide accurate shipping information.

4. Payment

Prices are listed on the Website and may change without notice. Payment methods currently accepted include bank cards and Apple/Google Pay. Payment is considered complete upon receipt of funds.

5. Refunds

Refunds are available within 24 hours after payment, provided the order has not been shipped. If the order has already been shipped, refunds are only available in cases where the poster is damaged upon delivery. In such cases, the Buyer may choose between a full refund or a replacement poster. Refunds will be processed to the original payment card.

6. Rights & Duties

• The Seller is responsible for producing and shipping the ordered posters within the stated timeframe.
• If the poster arrives damaged, the Buyer is entitled to a full refund or a replacement, subject to agreement between both parties.
• The Buyer is responsible for providing accurate personal and shipping information.
• The Buyer agrees not to reproduce, scan, or resell the purchased poster design.

7. Liability

Both parties are liable under Ukrainian law. The Seller is not responsible for delays caused by delivery services. Neither party is liable for force majeure events.

8. Privacy

The Buyer consents to the processing of personal data in accordance with Ukrainian law and the GDPR. The Seller does not share personal data with third parties.

9. Disputes

Disputes will be resolved through negotiation, and if necessary, through the courts of Ukraine.
